ALABAMA DIVORCE
UNCONTESTED DIVORCE:
This type of divorce is the easiest and least expensive. The cost should be no more than $1,000, including the filing fees (of course, all situations vary and you should always inquire as to the cost):
If the parties are in agreement as to a divorce and:
- Custody, if any, of children has been resolved, .
- Child support is not an issue, and
- All property issues are resolved (who gets the house, etc.?) and
- Issue of debts and taxes are resolved.
CONTESTED DIVORCE:
You want your rights protected, particularly with respect to issues involving custody, visitation, child support, property and debts.
You need an attorney who will remain emotionally detached and at the same time be a strong advocate for your rights. You need an attorney that will discuss all of these issues with you and any ramifications that may result in the future.
Alabama has provisions for joint custody of children and guidelines for amount of child support. Deviation in the amount of child support is permissible with a reasonable explanation for such.
