Child Support

Custody
If you seek custody of your child or children, then I will advise you regarding what will be required to obtain custody when custody has already been determined previously by a pre-existing court order.
In Alabama there are legal standards that you need to be aware of before that custody can be modified without the consent of the current custodial party.
You will need to be familiar with the McClendon Standard and what conduct or changes must occur since the last court order for you to meet that standard.
If you are seeking custody and there has been no prior custody determination, then now is the time to obtain important information regarding your rights. Has paternity been established? Are the mother and father married to each other?

PATERNITY
What rights do you as the father of a child have? That is an important question if you have not been adjudged the legal father of a child.
How do you become the legal father of a child?
1. Married to the mother of the child.
2. Paternity testing.
You may have signed to have your name placed on the birth certificate, but without either of the two above means being present, you are not the legal father. You may be the putative or the presumed father under Alabama law, but not the legal father.
In order to become the legal father paternity testing may be accomplished with no pain. Tests may be made easily and the results back in 4 to 6 weeks. Then, depending on the situation, a Family Court may adjudicate the paternity and create the legal status.
